Since
2002 the Program of Legislations and the Right to Communication of AMARC Latin
America and the Caribbean (ALC acronym in Spanish) has repeatedly petitioned
the IACHR to consider different violations of freedom of expression in the
region, derived from the regulations and existing practices in terms of the
concessions that grant the access and use of radio-electric frequencies.
During the last years, both the IACHR as well as its Special Rapporteur for
Freedom of Expression have been provided with evidence that the broadcasting
situation is a very important indicator of the degree of respect for freedom
of expression.
In this context, AMARC ALC believes
that it is extremely necessary that the diverse organizations of the Inter-American
System begin a detailed analysis of these matters, in order to check their
compatibility with the inter-American standards for freedom of expression
and, if necessary, formulating recommendations to adapt them. AMARC ALC has
promised to collaborate with inputs and this research, developed with the
support of the Ford Foundation, is a contribution to this task.
These are the foundations of the project "Democratic governance and standards
for the regulation of the access and use of radio and TV frequencies",
where one of the components is the publication of the results of the research
developed in eight countries of the region during 2008: Argentina, Bolivia,
Brazil, Chile, Mexico, Peru, Venezuela and Uruguay.
The book "The
invisible gags: New and old barriers to diversity in broadcasting"
(2009), analyzes the administration of the radio-electric spectrum (until
November, 2008) in terms of the concessions of radio and television in several
countries of the region. It aims at identifying the barriers and obstacles
which need to be overcome in order to effectively fulfill the right to information
access, where broadcasting is an integral part of that right following the
interpretive guidelines of article 13 of the American Convention of Human
rights. This website includes the chapters of the book and the technical reports
that support the judicial and administrative research in every country. (These
